Canadians impacted by a data breach involving MGM Resorts International can claim a part of a proposed $4 million settlement.

The data incidents occurred in July 2019 and September 2023. More than 37 million customers were affected by the cyberattack in July 2019.

As of now, eligible Canadians can claim compensation for substantiated losses up to $20,000 per approved claim. Compensation for unsubstantiated losses is capped at $150 for members of one data incident or up to $300 for members of both incidents.

MGM denies all allegations and liability regarding the data breaches. “No court has found MGM liable. The parties agreed to settle to avoid the risk and expense of continued litigation,” stated Diamond and Diamond Lawyers LLP.

The settlement approval hearing for the MGM class action is scheduled for May 25.

Meanwhile, Google reached a preliminary $135 million settlement in a class-action lawsuit over the misuse of Android users’ data. This settlement could potentially include up to 100 million Android mobile users in the United States.

Payments to eligible Android users are capped at $100. Users must have used an Android phone with cellular data between November 12, 2017, and now to qualify for this settlement.

Still, details remain unconfirmed regarding the actual disbursement amounts. “Payments are capped at $100. That doesn’t mean anyone will actually get $100, though,” noted an observer.

A final hearing for the Google settlement is on June 23.

This sequence of events highlights significant legal challenges for both companies and potential financial relief for impacted consumers.
